Building lease right

The building lease right (droit de superficie) allows someone to own buildings constructed on land that belongs to someone else.

It separates ownership of the ground from ownership of the buildings, for a limited period set in the deed. At its end, the buildings in principle revert to the landowner, under the agreed conditions.

Like the emphyteutic lease, it lowers the price of a home by separating out the cost of the land. The terms on duration, resale and end of the right are essential to check.
