Right of pre-emption
A right of pre-emption allows a person or a public body to acquire a property as a matter of priority, ahead of any other buyer, when it is put up for sale.
This right may be held by a commune, by the State or, in certain cases, by a tenant or a co-owner, depending on the nature of the property and the applicable rules. Where it exists, the seller must inform the holder of the right before completing the sale with another purchaser.
Whether or not such a right applies to a property is one of the legal checks carried out before the compromis de vente is signed.
