Condition precedent
A condition precedent is a clause that makes the sale depend on a future event: if it does not happen, the sale falls through without penalty.
The most common is obtaining the mortgage within a set time. Others include obtaining a building permit or selling another property.
It protects the buyer, provided it is drafted precisely: loan amount, term, maximum rate and the deadline for proving a bank refusal.
